Welcome to Skintology Apothecary (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website (skintologyapothecary.com), online booking platform, and all services, treatments, products, and consultations provided by Skintology Apothecary, including but not limited to facials, chemical peels, HydraFacials, injectables, advanced skincare treatments, and retail skincare products.

By accessing our website, booking an appointment, purchasing products or services, or visiting our location in Tyler, Texas, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Services and Medical Disclaimer

Skintology Apothecary offers elective aesthetic, skincare, and wellness treatments in a med spa setting. Our services include advanced facial treatments, chemical peels, HydraFacials, injectables (such as neurotoxins and dermal fillers), holistic skincare consultations, and retail skincare products.

Important Medical Disclaimer: All injectable and certain advanced medical aesthetic treatments are medical procedures. These services are performed under appropriate medical supervision in compliance with Texas regulations. Results vary by individual, and no specific outcome is guaranteed. Treatments are elective and cosmetic in nature. They are not intended to diagnose, treat, or cure any medical condition.

You acknowledge that you have been informed of the benefits, risks, alternatives, and potential side effects of any treatment. Informed consent is required prior to all medical procedures.

We reserve the right to refuse service to any client if, in our professional judgment, the treatment is not appropriate or safe for you.

2. Appointments, Cancellations, and No-Show Policy

Appointments must be booked in advance. We recommend arriving 10–15 minutes early for consultations and paperwork.
Cancellation Policy: You must provide at least 24 hours’ notice to cancel or reschedule an appointment without penalty. Cancellations with less than 24 hours’ notice or no-shows may result in a cancellation fee of up to 50% (or 100% for certain premium treatments/packages) of the scheduled service cost.
We reserve the right to charge the full amount for missed appointments.
Multiple late cancellations or no-shows may result in restricted booking privileges or required prepayment for future appointments.

3. Payments and Refunds

All services and products are payable at the time of service or purchase unless otherwise agreed.
We accept major credit cards, debit cards, cash, and approved financing options (if offered).
Refund Policy: Most aesthetic treatments and custom skincare services are non-refundable due to their personalized nature. Retail skincare products may be eligible for exchange or credit (subject to conditions) within 14 days if unopened and accompanied by proof of purchase. Opened or used products are non-refundable except in cases of documented manufacturing defects.
Package deals and memberships are non-transferable and subject to expiration terms. No prorated refunds for unused portions unless required by law.
Deposits for appointments are non-refundable but may be applied toward services if the appointment is kept.

4. Client Responsibilities and Eligibility

You represent that:

You are at least 18 years of age (or have parental/guardian consent if under 18 where permitted).
You have disclosed all relevant medical history, allergies, medications, and contraindications truthfully during your consultation.
You will follow all pre- and post-treatment care instructions provided by our team. Failure to do so may increase risks and void any guarantees or follow-up considerations.
You will not hold Skintology Apothecary liable for adverse reactions resulting from undisclosed conditions or non-compliance with instructions.

5. Liability Limitation and Release

To the fullest extent permitted by law, Skintology Apothecary, its owners, practitioners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or website.

You agree to release, indemnify, and hold harmless Skintology Apothecary from any claims, damages, or liabilities related to your treatment, except in cases of gross negligence or willful misconduct as determined by a court of competent jurisdiction.

We carry appropriate liability insurance, but individual results and reactions cannot be guaranteed.

6. Intellectual Property

All content on our website, including text, images, logos, treatment descriptions, and before/after photos (with client consent), is the intellectual property of Skintology Apothecary and protected by copyright and trademark laws. You may not reproduce, distribute, or use any content without our prior written permission.

7. Privacy and HIPAA

Your privacy is important to us. Personal and health information collected during consultations and treatments is protected under applicable privacy laws, including HIPAA where medical services are involved. Please review our Privacy Policy for details on how we collect, use, and safeguard your information.

8. Website Use and Online Booking

You agree to use our website and booking system only for lawful purposes. Prohibited activities include:

Providing false or misleading information
Attempting to interfere with the site’s functionality
Unauthorized access to any part of the system

We may update or discontinue features of the website at any time without notice.

9. Changes to These Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a new “Last Updated” date. Your continued use of our services after changes constitutes acceptance of the revised Terms.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas. Any disputes arising from these Terms or your relationship with Skintology Apothecary shall be resolved exclusively in the state or federal courts located in Smith County, Texas.

You agree to waive any right to a jury trial to the extent permitted by law.
